Information About Personal Data Processing by Meat Team Poland Sp. z o.o.
 

Acting on behalf of “Meat Team Poland” Sp. z o.o., I hereby declare that this “Information About Personal Data Processing by Meat Team Poland Sp. z o.o.” is addressed to natural persons, including natural persons acting on behalf of entities with which Meat Team Poland Sp. z o.o. concluded contracts (employees, associates, representatives and shareholders of contracting partners of Meat Team Poland Sp. z o.o.).

Below, please find some details pertaining to the processing of your personal data in relation to the entry into force, on 25 May 2018, of the GDPR, i.e. Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”).
 

I. Data Controller

The data controller is “Meat Team Poland Spółka z ograniczoną odpowiedzialnością” with its registered office in Warsaw at ul. Targowa 59, suite No. 7, 03-729 Warsaw, entered in the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Economic Division of the National Court Register, entry No. KRS: 0000212525, State Statistical No. (REGON): 015770350, VAT Reg. No. (NIP): 5242505462, with share capital of PLN 294,000.00 (hereinafter referred to as “Meat Team Poland”).
 

II. Processing Purposes and Grounds

If you are an entity conducting business activity which is or was a party to a contract with Meat Team Poland, your personal data are processed:

  1. to take steps prior to entering into a contract and for the performance of a contract entered with you, including to contact you in relation to the contract; The legal grounds for processing your personal data in this respect is Art. 6(1)(b) of the GDPR.
  2. for purposes of the legitimate interests pursued by Meat Team Poland as the data controller, i.e. establishment, exercise or defence of claims which may result from failure to perform or improper performance of the contract binding you with Meat Team Poland. The legal grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.
  3. to present you with an offer of sale or purchase of goods. The legal grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.
  4. for purposes resulting from obligations encumbering Meat Team Poland based on legal provisions, in particular based on tax/accounting provisions. The legal grounds for processing your personal data in this respect is Art. 6(1)(c) of the GDPR.

If you are an employee, associate, representative or shareholder of an entity with which Meat Team Poland Sp. z o.o. concluded a contract (a contracting partner of Meat Team Poland), your personal data are processed:

  1. to take steps prior to entering into a contract and for the performance of a contract entered with the entity on whose behalf of you are acting, including to contact you in relation to the aforementioned contract; The legal grounds for processing your personal data in this respect is Art. 6(1)(b) of the GDPR.
  2. for purposes resulting from the legitimate interests pursued by Meat Team Poland as the data controller, i.e. establishment, exercise or defence of claims which may result from failure to perform or improper performance of the contract binding Meat Team Poland with the entity on whose behalf you are acting. The legal grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.
  3. for purposes resulting from obligations encumbering Meat Team Poland based on legal provisions, in particular based on tax/ accounting provisions, if your data were provided in the contract or in other documents related to the performance, by Meat Team Poland, of obligations resulting from legal provisions, in particular tax provisions and accounting provisions. The legal grounds for processing your personal data in this respect is Art. 6(1)(c) of the GDPR.

If you are a potential contracting partner of Meat Team Poland or if you are acting on behalf of a potential contracting partner of Meat Team Poland, your personal data are processed:

  1. to take steps prior to entering into a contract. The legal grounds for processing your personal data in this respect is Art. 6(1)(b) of the GDPR.
  2. to respond to inquiries or notifications submitted by you. The legal grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.
  3. to present you again with an offer of sale or purchase of goods. The grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.
  4. for purposes resulting from the legitimate interests pursued by Meat Team Poland as the data controller, i.e. establishment, exercise or defence of claims which may result from failure to perform or improper performance of the agreement binding you with Meat Team Poland. The legal grounds for processing your personal data in this respect is Art. 6(1)(f) of the GDPR.

 If you contact Meat Team Poland via the contact form located on https://www.meatteam.pl/kontakt, your personal data is processed in order to respond to the contents addressed by you to Meat Team Poland. The legal basis for processing your data in this regard is Article 6(1)(a) of the GDPR. However, if the content sent via the contact form will concern your intention to conclude an agreement with Meat Team Poland directly or by a contractor on whose behalf you act, the legal basis for processing your personal data will then be the legal grounds indicated in the preceding paragraph, provided for potential contractors of Meat Team Poland.

 

III. Categories of Your Personal Data Processed by Us

Depending on the purpose and the legal grounds of processing your personal data, Meat Team Poland may process the following data:

  • first name;
  • surname;
  • telephone No.;
  • e-mail address;
  • position;

and if you are a party to a contract with Meat Team Poland, also:

  • address of the place of business activity conducted by you;
  • VAT Reg. No. (NIP);
  • your bank account number;
  • other (than first name and surname) specifications included in your business name.
     

IV. Data Recipients

Depending on the purpose and the legal grounds of processing your personal data, Meat Team Poland may make the personal data available to the following categories of entities:

  1. employees or associates of Meat Team Poland who may have access to your personal data in relation to their duties, based on contracts concluded with Meat Team Poland;
  2. entity providing legal services for the benefit of Meat Team Poland;
  3. entity providing IT services for the benefit of Meat Team Poland;
  4. entity providing tax services for the benefit of Meat Team Poland;
  5. banks with which Meat Team Poland is bound by a contract on maintenance of a bank account for the benefit of Meat Team Poland;
  6. insurance carrier or an entity conducting pre-court debt collection for Meat Team Poland;Meat Team Poland’s insurance broker;
  7. entity providing transportation services/ shipping services, including courier companies;
  8. public operator - Poczta Polska S.A.;
  9. public authorities and entities performing public tasks or acting at the commission of public authorities within the scope of and for purposes that result from the provisions of generally applicable law.
     

V. Transfer of Data to Third Countries or International Organisations

We do not transfer your data to countries outside of the European Union or to international organisations.
 

VI. Term of Data Storage

Subject to the second paragraph, your personal data shall be kept by Meat Team Poland until the end of the period of expiry of potential claims, which may result from failure to perform or improper performance of the contract/ contracts concluded by you with Meat Team Poland (or agreements concluded by Meat Team Poland with a contractor on whose behalf you are acting) or until the end of the period of the tax liability, whichever of the aforementioned periods takes place later.

If your personal data were processed for the purpose of entering into a contract, but no contract was entered into, the personal data shall be processed for 1 year from the day of the last contact with you, unless longer storage of your personal data will be justified by potential claims which may result from failure to conclude the contract - in such case, your personal data shall be stored until the end of claim expiry period.

If your personal data were processed in order to respond to the content addressed by you to Meat Team Poland via the contact form placed on https://www.meatteam.pl/kontakt, your personal data are stored for a period of one month, unless the content concerned a direct intention to conclude a contract with Meat Team Poland - then the data storage period referred to in the previous paragraph applies.

 

VII. Your rights:

You are vested with the following rights:

  1. the right to withdraw your consent at any time in the event that you have given such consent when submitting content to Meat Team Poland via the contact form located at https://www.meatteam.pl/kontakt; withdrawal of consent will not affect the legality of the processing performed on the basis of consent before its withdrawal;
  2. right to access your data and receive a copy of your data;
  3. right to request rectification of your personal data which are incorrect. In observance of the purposes of processing, you have a right to request completion of incomplete personal data, including by presentation of additional declaration;
  4. right to remove data in the following situations:
    1. when your personal data are no longer necessary for purposes for which they were collected or for which it was processed in another manner;
    2. when you filed an objection pursuant to Art. 21(1) of the GDPR against the processing and there are no compelling legitimate grounds for the processing of data by Meat Team Poland;
    3. when you filed an objection pursuant to Art. 21(2) of the GDPR with respect to the processing of your data for direct marketing purposes - where your personal data are processed for direct marketing purposes;
    4. when your personal data were processed in violation of the law;
    5. when your personal data must be removed for the purpose of meeting a legal obligation foreseen in the EU law or the law of a member state to which Meat Team Poland is subject as the data controller.
  5. Simultaneously, please be informed that the right to remove data is not exercised within the scope in which the processing is necessary to: exercise the right to freedom of expression and information; meet the legal obligation requiring processing pursuant to the EU law or the law of a member state to which Meat Team Poland is subject; establish, seek or defend claims.
  6. Right to file an objection
    1. due to causes related to your special situation - with respect to the processing of your personal data by Meat Team Poland for purposes of legitimate interests pursued by Meat Team Poland when the processing of your personal data is necessary to meet the aforementioned purposes. In case you file such objection, Meat Team Poland shall not process the personal data covered by the objection, unless Meat Team Poland demonstrates the existence of significant legally justified grounds for processing, overriding with respect to your interests, rights and freedoms or when it is necessary to establish, seek or defend claims.
    2. if your personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, to the extent that it is related to such direct marketing.
  7. right to request Meat Team Poland to limit the processing of your personal data in the following cases:
    1. when you challenge the correctness of personal data - for a term allowing Meat Team Poland to verify the data correctness;
    2. the processing is inconsistent with the law and you object to deletion of personal data, demanding, in exchange, limitations in the use of such data;
    3. Meat Team Poland no longer needs the personal data for processing purposes, but they are necessary to you to establish, seek or defend claims;
    4. when you filed an objection pursuant to Art. 21(1) of the GDPR against the processing - until it has been determined whether the legitimate grounds on the side of Meat Team Polan are overriding with respect to your objection.
  8. right to file a complaint to a supervisory authority - if you believe that Meat Team Poland processes data in violation of the law, you can file a complaint to a supervisory authority, which was established in relation to entry into force of the GDPR or a Polish act bringing the domestic provisions into conformity with the GDPR regulations.

Please remember that prior to the exercise of your rights, Meat Team Poland must be certain that Meat Team Poland is talking to the data subject, i.e. you will have to be adequately identified.
 

VIII. Information on the Requirement to Provide Data/ Voluntary Provision of Data

Provision of your personal data is voluntary, yet necessary for entering into, performance and accounting and tax clearance of the contract concluded by Meat Team Poland with you. If you refuse to provide your personal data, entering into a contract with Meat Team Poland shall not be possible, as well as performance of the contract and completion of the accounting and tax clearance.

If you are a party acting on behalf of a contracting partner of Meat Team Poland (including an employee, associate, representative or contracting partner), provision of your personal data directly to Meat Team Poland is voluntary, yet also necessary for entering into, performance and accounting and tax clearance of the contract by Meat Team Poland with the contracting partner whom you are representing.

If you are a potential contracting partner of Meat Team Poland or if you are acting on behalf of a potential contracting partner of Meat Team Poland, provision of your personal data is voluntary, yet necessary to take steps aimed at establishment of trade relations, including submission of an offer and conclusion and performance of the contract and subsequent accounting and tax clearance.

If you contact Meat Team Poland by filling out the contact form at https://www.meatteam.pl/kontakt, providing your personal data is optional; however, without providing your e-mail address, it will not be possible to respond to your content sent via the contact form.

 

IX. Information About Source of Data

Your personal data may be collected by Meat Team Poland from a generally available source, which is the Business Activity Central Register and Information Record (CEIDG), from the contracting partner, on whose behalf you are acting, as well as directly from you.
 

X. Information About Automated Decision-Making

In reference to your personal data, no automated decisions shall be made; your personal data shall not be subject to automated profiling.
